Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the utilization of improvised objects as climbing devices (e.g. as ladders, ladder stands): (a)On or about March 26, 2010, employees climbed and stood on boxes or chairs to reach the pizza oven controls. The condition exposed employees to a fall hazard as well as a burn hazard from the hot oven rack. ABATEMENT NOTE: Among other methods, feasible and acceptable means to correct the condition include: 1. Discontinue the practice of climbing on boxes, chairs, and/or other improvised devices. 2. Provide personnel with an ANSI approved ladder and/or ladder stand. 3. Train personnel on the dangers of utilizing improper climbing devices.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to improperly located oven controls that placed personnel in hazardous situations: (a)On or about March 26, 2010, employees had to reach 38 inches across a hot rack to turn access and manipulate the pizza ovens. The condition potentially exposed personnel to a burn hazard. ABATEMENT NOTE: Among other methods, feasible and acceptable means to correct the condition include complying with - NFPA 79 Electrical Standard for Industrial Machinery which states: Chapter 10 ~ "hand-operated control devices shall be selected and installed as follows: (1)They are not less than 0.6 m (2 ft.) above the servicing level and are accessible from the normal working position of the operator. (2)The operator is not placed in a hazardous situation when operating them.ting
