Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to a struck by hazard: a) Williams Foundations, Inc., at 1030 South Franklin Street, Denver, CO 80209: On September 23, 2008, the employer did not ensure that policies, procedures and comprehensive training was in place to ensure that all personnel were cleared from the area of the end hose when starting or restarting the pump. Air in the line during the pump start up caused the hose to whip and knocked an employee holding the end of the hose off of formwork. This condition caused an employee to fall approximately 10 feet and sustained head injuries. Among other methods, one feasible and acceptable abatement method to correct this hazard include, but are not limited to: 1) Follow the procedures outlined in the Concrete Pump Manufacturers Association procedures for safe operation, Safety Standard for Concrete Pumps, Placing Booms and Delivery Systems, Section 27-1.18.2.2 paragraph# 10, states that; "Personnel should be cleared from the area of the end hose when starting or restarting the pump." 2) Develop and implement workplace policies, procedures and comprehensive training programs for employees to ensure that personnel are clear from the area of the end of the hose when starting or restarting the pump.
