Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a tipping hazard.
a)Lot:Employer failed to require employee to wear restraint device when
exposed to a
tipping hazard.
Violation observed on or about 4/14/08.
AMONG OTHER MEANS, ONE FEASIBLE METHOD TO CORRECT THIS HAZARD
WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE
SEATBELTS AND REINFORCE THIS REQUIREMENT TO THE EMPLOYEES DURING
TRAINING.
AMERICAN EAGLE PALLET WAS PREVIOUSLY CITED FOR A
VIOLATION OF THE OCCUPATIONAL SAFETY AND HEALTH
STANDARD FOR IT'S EQUIVALANT SECTION 5(a)1, WHICH
WAS CONTAINED IN OSHA INSPECTION #308293737, CITATION
#1, ITEM 001 ISSUED ON 1/5/06 WITH RESPECT TO A
WORKPLACE LOCATED AT 35 CUTTERS DOCK ROAD, WOODBRIDGE,
N.J. 07095.  THE FINAL ORDER DATED WAS 2/1/06.
