Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling into the elevator shaft and/or being
struck by the elevator
car:
a/  The Baker/Milford NJ Site - Production Area:  The 'Freight Elevator'
used to
ascend/descend from the basement to the second level of the facility was
not in proper
operating condition, in that, the gates to the elevator on each level were
not designed to
prevent the gates from being opened when the car was not on that level.
Observed on
or about 9/23/08.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to:
1/  Provide interlocks (limit switches) on each gate of freight elevator.
a/  The interlock device shall hold the gate in the locked position by
means of gravity
or by a restrained compression spring, (or by both) and/or by means of a
positive
linkage.
b/  The interlock device shall lock the door in the closed position before
the elevator
can be operated.  When the interlock is released, the elevator is to be
rendered
inoperable.
2/  And/or other approved means.
