North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to: the possibility of death from falling objects
or struck by objects when exposed to
overhead (underhung) hoists that had not been inspected
a)facility, welding shop - Coffing overhead (underhung) hoists, serial
numbers EC3E163UJ,
EC1C232RL,EC1230RL,and EC1634980, which had been placed in service in
March 2007,
were not provided with an initial, frequent, or periodic inspection until
July 23, 2008.  These
hoists were used to lift steel frames of an unknown weight. On July 29,
2008, this weight was
calculated at 4,687 pounds.
