Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment or a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)On or about January 15, 2009, and at times prior, employees were exposed to fire and explosion hazards were an open flame was maintained at the well head. Among other methods, one feasible and acceptable method to correct this hazardous condition would be to not have any potential ignition sources at or near the well head, in accordance with American Petroleum Institute Recommended Practice (API RP 54) for Occupational Safety for Oil and Gas Well Servicing Operations, Section 7.1.7. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment or a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to structural collapse of the rig: a)On or about January 15, 2009, and at times prior, employees were exposed to crushing injuries where underneath the dog house, pins connecting the structural members of the rig were not secured with cotter pins or any other type of retention pins. Among other methods, one feasible and acceptable method to correct this hazardous condition would be to install cotter pins or other types of retention pins in accordance with section 9.2.8 of the American Petroleum Institute Recommended Practice 54. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").
