Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to falls and crushing injuries while working from elevated crane- mounted man-baskets in unsafe, high wind conditions: a) On or about February 26, 2009 and at times prior, employees were exposed to falls of up to 100 ft and crushing injuries while working from and operating man-baskets attached to Manitex 35124C hydraulic cranes in unsafe, high-wind conditions. The employer had no set criteria to follow to cease personnel lifting operations in windy conditions. The employer also did not have a means to measure wind speed. Among other methods, a feasible and acceptable method to correct this hazard is to follow the requirements of the manufacturer (Manitex) to cease personnel lifting operations when wind speeds reach or can exceed 20 mph. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
