Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards: a) On or about August 3, 2009 and at times prior, employees were exposed to falls in excess of 50 feet while performing window cleaning operations on a boatswain's chair with a rope descent system due to the following deficiencies: 1. The life line for the fall arrest system and tieback line for the portable rolling outrigger unit were attached to structures on the roof with unknown strengths that were not certified anchor points. 2. Employees were not using full-body harnesses as part of their personal fall arrest system. Seat-type, recreational/sport style climbing harnesses were in use for suspended work. 3. The boatswain's chair in use (Sky Genie) did not effectively secure the worker in the chair in that, a restraint strap had been removed. 4. The employer did not have an effective rescue plan in place to promptly rescue an injured or disabled worker during suspended work. 5. The employer did not have a representative at the site who was qualified and proficient in the instruction and supervision of safe work procedures for this type of work. 6. Employees were not provided with effective training on rope descent systems and fall arrest systems so as to be proficient in safe work procedures and proper use of this equipment. 7. Access to the area located below suspended work was not effectively blocked by barricades. Warning signs were also not placed in the area. 8. The life line in use for suspended work had visible wear and frays along the length of the rope and was not removed from service. 9. The part of the roof where the portable outrigger unit was placed was not reviewed by a registered professional engineer as to what load the surfaces would support. Abatement Note: Among other methods, a feasible and acceptable method to correct these hazards is to follow the requirements of American National Standards Institute/International Window Cleaning Association (ANSI/IWCA) I-14.1-2001, Window Cleaning Safety. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement-Certification Letter").
