NCGS 95-129(1) section 5(a)(1) of the Occupational Safety and Health Act
of 1970:  The
employer did not furnish employmnent and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
a)facility shop - being caught between the forklifts frame and the ground
in the
event the vehicle was upset or turned over. The operator was not wearing a
seatbelt while operating the Cat Model 300 forklift serial number SDP00150.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard was to install a seat belt and to require the operator to wear the
installed seatbelt
while operating the forklift.
