Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about July 25, 2008, and at times prior thereto, at the job site
located on the
corner of 50th and Grand Ave., Fort Smith, Arkansas, an employee was in a
trench box,
while pipe was being lowered into the excavation/trench box without tag
lines attached
to the pipe, exposing the employee to the hazard of being struck by
uncontrolled loads.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to use one or more guide ropes or tag lines to prevent rotation or
uncontrolled motion of the
load being lowered and make sure employees stand clear while the load is
being lowered.s
