Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from an elevated work platform to the ground below. a)GMC Boom Truck Florida License # N61750 - Elliott Elevated Work Platform Employees working in the work platform which contained a severely bent top guardrail, a platform floor hole and a missing top rail at the platform's entry/exit point, on or about, 08/05/08. ONE FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO: 1) Follow the American National Standard A92.2-1990 entitled "Vehicle-Mounted Elevating and Rotating Aerial Devices", Section 8.2.3 entitled "Frequent Inspection and Test", which states under item # (6), that "All unsafe items shall be replaced or repaired before use". Also Section 8.2.4 entitled "Periodic Inspection and Test", which states that inspections shall include (1) Structural members for deformation, cracks or corrosion.
