Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a fall hazards:
a) Shipping/Receiving Area: A supervisor was elevated to a height of
approximately
15 feet while standing on the forks of the Hyster forklift to make repairs
to an
overhead door. No fall protection was utilized, on or about 02/25/09.
b) Shipping/Receiving Area: A machine operator was elevated to  heights of
approximately 10 to 15 feet while standing on a wood pallet attached to
the forks of
the Hyster forklift to retrieve/store materials. No fall protection or
guardrails were
utilized, on or about 02/20/09.
Among others, one feasible and acceptable method to abate this hazard is
to
use a platform
meeting the design and use criteria set forth in the Industrial Truck
Standards Development
Foundation (ITSDF) B56.1-2005 standard.
