Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed fall hazards and struck-by hazards: In the Cox Convention Center on or about November 14, 2008, and times prior thereto, employees were using a self-supporting aluminum ladder to gain access to the roof of the sound booth on the north end of the arena. The ladder was too short and required employees to use the top step and top cap of the ladder. Feasible means of abatement for this hazard, among others, is to ensure the use of a properly sized and type of ladder for the application or to install a fixed ladder at this location that meets the requirements set forth in 29 CFR 1910.27.
