Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Mercy Life - The employees were exposed to toxic fumes resulting from improper use and storage of incompatible chemicals. These chemicals were Sodium hypochlorite [e.g. bleach] and Phosphoric Acid [e.g. Don Low Foam Delimer]. An employee was treated for exposure on October 22, 2009. NOTE: Because abatement of this violation has been performed [e.g. The physical separation of incompatibles], the employer does not have to perform certification of abatement for this violation.
