Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to fall hazards: At site S109, NE of Texas Gulf Wind Project: On or about 11/09/08, employees are exposed to fall hazards. This exposure occurs while ascending and working upon the following unsecured steel tower sections vertically positioned upon the ground: a.Metrology tower segment S09, b.Metrology tower segment S06-1. Pursuant to 29 CFR 1903.19, the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that vertically positioned, ground supported tower segments are properly anchored prior to use by employees. Among other methods, one feasible and acceptable abatement method to correct this hazard is to properly secure the tower to the ground using an approved system of anchoring devices.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck-by hazards: At site S109, Texas Gulf Wind Project: On or about 11/09/08, employees are exposed to being struck by falling tower section while working near unsecured steel tower sections. The following sections are vertically positioned upon the ground with potential for being accidentally toppled by wind gusts, employee climbing activities, or unstable tower footings: a.Metrology tower segment S09, b.Metrology tower segment S06-1. Pursuant to 29 CFR 1903.19, the employer must submit documentation showing it is in compliance with the standard, including describing the steps it is taking to ensure that vertically positioned, ground supported tower segments are properly anchored prior to use by employees. Among other methods, one feasible and acceptable abatement method to correct this hazard is to properly secure the tower to the ground using an approved system of anchoring devices.g
