Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falls:
(a)On or about 07/21/09, at the construction site located at 711 Broadway,
Marble
Falls, TX, two employees were working from a Genie scissor lift where the
chain to the access
opening was not latched, and one employee was standing on the midrail of
the Genie scissor lift
to reach higher work elevations, exposing employees to the hazard of falls.
One feasible method is to comply with the manufacturer's requirements and
ANSI/SIA A92.6-
1999 for Self Propelled Elevating Work Platforms. Section 8.8 (3)
Guardrail System.
"Guardrails shall be installed and positioned, and access gates or
openings shall be closed per
manufacturer's instructions." and Section 8.10 (9) Personnel Footing.
"Personnel footing.
Personnel shall maintain firm footing on the platform floor while working
thereon. Climbing by
occupants on the midrail or toprail of the aerial platform is prohibited.
The use of planks,ladders
or any other devices on the platform for achieving additional height or
reach is prohibited."
