Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of:
a)  At the site, an employee was operating a scissor lift to remove a
banner which was
attached to the ceiling.  While operating this scissor lift the employee
did not have the midrail
chain attached, thus exposing the employee to a fall hazard.
Among other methods, one feasible and acceptable abatement method to
correct the fall hazard
is to train employee to follow the Manufactures rules.  The rules per the
Operator's Manual
state: "Do not sit, stand or climb o the platform guard rails".m
