North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fall and caught in-between
hazards:
a) on the construction site, the wooden platform that was used to lift two
employees
was not securely attached to the lifting carriage and forks of the Gehl
Dynalift
rough terrain fork truck, resulting in a 23 ft fall.

Among other methods, one feasible and acceptable method to abate this
hazard
is to ensure all personnel platforms are constructed to adequately support
personnel and to ensure the platforms are securely attached to the forks
and
carriage of the forktruck.
