Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards while using improperly maintained mobile
ladder stands:
a) Warehouse Area - On or about April 16, 2009, an employee was using a 5
riser
mobile ladder stand with missing and damaged parts exposing the employee
to a fall
injury from no less than 48 inches above grade.
b) Warehouse Area - On or about April 16, 2009, employees were using a 5
riser mobile
ladder stand with missing labeling which did not provide employees with
information
relating to maximum safe load rating potentially exposing employees to
fall hazards no
less than 48 inches above grade.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is: Comply with the manufacturer's requirements and
ANSI A14.7-1991
for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3
requires: "Units that
are damaged subsequent to their receipt, and/or are worn beyond repair
shall be destroyed.
Never climb a damaged ladder stand or ladder."  Section 7.2.1, Item 3
states, "Each unit shall
be marked with: Maximum rated load." Section 7.2.3 reads, "The owner of a
unit, or employer
having supervisory control of a unit, has the total responsibility for its
proper inspection, setup,
use, and maintenance."
