Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling. On or about April 8, 2009, and at times thereto, at the work-site located at Wal-Mart 98, 322 Brownsville Road in Lonoke, Arkansas, an employee working from a self-propelled elevating work platform [Genie Model GS 1930 SN426440,scissor lift] was exposed to injuries from falls should the lift malfunction causing a collapse, overturn or other adverse action because the owner/employer did not cause frequent and annual inspections to be performed on the lift. One feasible method of abatement, among others is to cause frequent inspections to be performed in accordance with Section 6.6, FREQUENT INSPECTION and Section 6.7, ANNUAL INSPECTION of the American National Standard Institute, ANSI/SIA A92.6-1999.
