North Carolina General Duty Statute 95-129(1) of the Occupational
Safety and Health Act of North Carolina:  The employer did not
furnish employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to fire and explosion hazards:
a)production area, grinding of polyurethane conveyor belts
created dust which was collected in a dust collector
located on the inside of the building and not separated
from the operation. Reference: NFPA 654 Chapter 6,
Section 6.2.1.
b)production area, hopper was not interconnected and
grounded to the metal drum used to collect the dust.
Reference: NFPA 654, Chapter 9. Section 9.3.1.3.
Abatement Note: On feasible method of abatement will
include but not be limited to installing the dust
collection system outside the facility. NFPA 654 Chapter
7, Section 7.13.1.1.1. "Where an explosion hazard exists,
air-material separators shall be located outside of the
buildings."
