Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
On or about July 17, 2009, and at times prior thereto, with respect to the
jobsite on 14th
Street in Bentonville, Arkansas, where employees were engaged in road
building
activities.  Employees were observed working beside an active roadway and
were not
wearing high visibility garments.  This created a condition which exposed
the employees
to the hazard of being stuck by moving vehicles.  Among other methods, one
feasible
means of abatement to correct this hazard is to follow Chapter 6D,
Pedestrian and
Worker Safety, as delineated in the Manual on Uniform Traffic Control
Devices, 2003
Edition, and use high visibility apparel.  No abatement certification or
documentation
is
required for this violation.ion
