Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to being run
over, caught in or
struck-by hazard:
On or about March 17th, 2009 at the Richard Robek tomato farm, employees
were exposed to
the hazard of being run over, caught in or struck-by farm equipment while
crew members were
performing tomato picking operations.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is:
a) prohibit employees from working near the farm equipment;
b) to ensure that all crew members are in a safe place before starting or
moving farm equipment;
c) train employees and enforce work rules.
