Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that powered industrial truck operators were exposed to: a)On or about 2/4/2010, at 5555 NW 36th Avenue, Miami, Florida, a Nissan and Clark powered industrial truck was being operated without attaching a seat belt exposing employees to falling and crushing hazards. b)On or about 2/4/2010, at 5555 NW 36th Avenue, Miami, Florida, employees were exposed to a fall hazard by standing on a pallet while being lifted by a Nissan and Clark powered industrial truck. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to follow the manufacturer's recommendation prohibiting people from being lifted by the powered industrial truck and the use of a seat belt assembly as referenced by the American Society of Mechanical Engineers/American National Standards Institute, ASME/ANSI B56.1 NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
