Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: Struck By Hazards
On or about April 13, 2009, an employee was injured when the tractor that
he was using
unexpectedly began traveling after the ignition was engaged.  The
Transmission Neutal Safety
Switch was found inoperable.  This allowed for the tractor to unexpectedly
travel on it's own
without a driver in the seat.  The New Holland Operators Manual
TC35A/40A/45A and the
National Agricultureal Safety Database - Landscape Safety Series:
specifically warn against
bypassing the various safety switches on the tractor.
Feasible means of abatement include and are not limited to:
1. Train employees to properly inspect the vehicle prior to use and to
recognize
potential hazards
which could cause accidents or injuries;
2. Train employees to follow proper operation procedures such as starting
the tractor from the
seated position and placing the tractor in neutral before starting or at
shutoff;
3. Perform required maintenance and repair within the guidelines of the
owner's manual or
ensure an outside company certified in equipment repair performs the
proper diagnostics and
repair of the vehicle.
