Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to entanglement, crushing, and/or struck by hazards due to the sudden and unexpected release of a manually lifted suspended load. a) VILLAGE COMMONS, SOUTH HADLEY MA WORK SITE; ON 11/17/2010, WORKERS ON A SCAFFOLD 32 FEET FROM THE GROUND WERE MANUALLY HOISTING A 248 POUND DEBRIS CHUTE WHICH WAS TO BE INSTALLED ON THE END FRAME OF THE SCAFFOLD. DURING THE MANUAL HOISTING OF THE CHUTE, THE CHUTE UNEXPECTEDLY DROPPED, EXPOSING FOUR WORKERS TO LIFTING LINE ENTANGLEMENT, CRUSHING AND STRUCK BY INJURIES. 2. USE A CRANE OR OTHER EQUIVALENT MECHANICAL LIFTING DEVICE TO INSTALL THE CHUTE.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a possible entrapment of the head and torso between the forklift and the floor or other surface while operating the forklift should a tip-over of the forklift occur. One feasible and acceptable abatement method to correct this hazard is to provide an operator protection (restraint) device on the forklift such as seat belts.
