Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious injury or death by point of operation, ingoing nip points, rotating parts, flying chips, and sparks due to one employee standing on top of a wood chipper and also riding while sitting in the in-feed hopper while the wood chipper was operating. a)Jobsite: On 02/10/10 and times prior thereto, employees were exposed to serious injury or death by standing on top of the chipper while using a pole chain saw to cut limbs, and rode on top to the next site while other employees were feeding the cut limbs and brush into the chipper. In addition, the employees were riding while sitting in the in-feed hopper while the wood chipper was operating and moved from one cutting location to the next. Note 1: Among other methods, one feasible and acceptable means of abatement would be for the employer to comply with the American National Standard for Arboricultural Operations - Safety Requirements (ANSI Z133.1-2006) which states: Paragraph 5.1.9. Riding or working outside or on top of units shall not be permitted unless the units are designed for that purpose or the operator is performing maintenance or inspection. Paragraph 8.6.11. Hands or other parts of the body shall not be placed into the in-feed hopper. Note 2: Abatement certification and documentation is required for this item.
