General-duty citation text

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to a fall hazard:
(a)The employer did not ensure that the personnel lifting platform used on
forklift(s)
to elevate personnel to an elevated position, was not constructed in
accordance
with ASME B56.1, Safety Standard for Low Lift and High Lift Trucks, Section
4.17 Elevating Personnel.
The platform did not have toe boards.
There was no means in place to secure the lifting platform to the forks or
lifting carriage.
Guardrails did not meet design requirements in-that the midrail was 28
inches from the
platform floor and the top rail was 43 inches from the platform floor. The
removable
chain rails were installed at 11 inches and 28 inches from the bottom of
the platform
floor. Top rail chain was 43 inches. Chains also did not have a
discernable secured
position, in that the chain links did not secure fully over the securing
attachment point.
The platform did not identify the maximum loading rating and empty weight
of the work
platform.
A feasible means of abatement includes but is not limited to ensure that
the personnel
elevating platform meets the requirements of ASME B56.1-1993 Safety
Standard for Low
Lift and High Lift Trucks.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
