Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) On or about July 28 and July 29, 2009, sanitation collection worker(s)
operating in short
duration/frequent stop operations while emptying waste receptacles into
rear-loader compacting
trucks did not wear high visibility outerwear or use equivalent personal
protective equipment and
employee(s) were exposed to struck-by and/or crushing hazards of on-coming
traffic.
Among other methods one feasible and acceptable method to correct this
hazard would be to:
-Ensure that employees are provided with the appropriate protective
equipment and follow
the Pike Sanitation Safety and Health policy manual adopted from the
National
Solid Waste
Management Association (NSWMA) Section 5.1 Personal Protective Equipment
selection table
for Rear Load Collection, Residential Helpers and Commercial Rear Load
Drivers where the
use of enhanced visibility personal protective equipment is identified as
being mandatory; and,
-Ensure drivers follow ANSI Z245.1-2008 as recommended by NSWMA, which
includes
among other precautions, in Section 6.1.7.8 High Visibility Apparel,
requiring high visibility
apparel as appropriate to the task assigned to employees will experience;
and, in Section 6.2.3.3
Personal Protective Equipment, requiring the employee use of personal
protective equipment and
high visibility apparel as required by the employer.
