Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On or about 08/05/09; During construction activities; The bucket of the
Komatsu PC220LC
Excavator was used to transport an employee from the shore line to a small
concrete block
located approximately 15 to 20 feet out into approximately 8 feet of
water. Among other
methods, feasible and acceptable abatement methods include, but not
limited to the following:
a. Follow the Equipment Manufacturers Institute safety manual for
operators and mechanics of
hydraulic Excavators which states "Never use a bucket for a work platform
or personnel carrier"
and b. Follow the Komatsu Operators manual for a PC220LC which states
"Your excavator is
a ONE-PERSON Machine. NEVER PERMIT RIDERS IN THE BUCKET.
