Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to fire hazards during cutting operations in the work shop. On or about April 27, 2010 and at times prior thereto, an employee was cutting some metal bars using a Makita chop saw. During the cutting of the metal bars, showers of sparks were produced. The chop saw was located on the floor within approximately 6 feet of some cumbustible material, to include a cardboard drum with a 24 inch diameter opening in the top, that was sitting near the back wall of one of the offices. The employee had finished cutting the metal bars and had gone around the east side of the building towards the front offices. Within a few minutes the employee was on his way back to the work shop when he saw smoke coming out of the shop near the area where he had been working. Among others, a feasible and acceptable method to correct this hazard is to not allow hot work near or around flammable or combustible materials. The National Fire Protection Association (NFPA) 51b, section 3.3.2 defines "Hot Work" as work involving burning, welding or a similar operation that is capable of initiating fires or explosions.
