Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of burns resulting from fires created by the
storage of incompatible
chemicals:
a)  On or about October 16, 2009 and at times prior, employees were
exposed to a burn
hazard while they stored flammable liquids such as n-butyl acetate and
methyl ethyl
ketone in a refrigerator with at least four gallons of High Point 90
catalyst which
contained 40methyl ethyl ketone peroxide (MEKP).
b)  On or about October 22, 2009 and at times prior, employees were
exposed to a burn
hazard while they stored acetone next to a bottle of High Point 90
catalyst (which
contained 40MEKP) in the resin mixing area.
NFPA 432 (4.11.3.1) and material safety data sheets require that strong
oxidizing agents
such as MEKP be kept separately from flammable liquids.
Abatement:
Among other methods, one feasible and acceptable abatement method to
correct the
hazard is to move all flammable liquids that are not in use to the
flammable liquid
storage room which already exists on the site.
Abatement Note:  Abatement certification is required for this item (see
enclosed
"Sample Abatement-Certification Letter").
