Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that,
employees were exposed to head injuries:
a) On or about November 30, 2009 and times prior, employees were throwing
roofing
materials off the roof exposing employees on the ground to serious
injuries from being struck
by these roofing materials.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to ensure that employees are not in the area where materials are
hitting the ground. A
warning tape would be placed around the collection bins and employees
instructed not to
cross the boundary of the warning tape.
