Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to inhalation hazards associated with low oxygen levels: On or about November 23, 2009, and at other times prior thereto, around the Air Products Cryo-Quick Freezer, the left fixed ventilation fan was not maintained and kept fully functional. Employees operating and maintaining this equipment were exposed to hazards of working in a low oxygen atmosphere (nitrogen offgas as a simple asphyxiant). Among others, one feasible means of abatement would be to maintain regular mechanical inspections and tests of the dedicated machine ventilation system and provide an area oxygen sensor and alarm, in accordance with the Air Products SafetyGram 47 - "Guidance for the Safe Operation of Liquid Nitrogen Food Freezers."
