Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to impalement hazards:
(a)On the west side of the building under construction: On 10
September 2009 and at times prior to; employees were exposed
to impalement hazards by falling onto form pins that measured
between 18-24 inches in height.
Among other methods, one feasible and acceptable method to correct this
hazard is: Install
caps over forming pins or install forming pins to level of form or grade.
