Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees. a.Dynarex Corporation, located at 702 E. Montford Avenue, Ada, OH: On or about March 30, 2011, employees were exposed to approximately a fourteen feet fall hazard when working from a wooden pallet that was elevated with the Hyster forklift (Model E50XL- 33, Serial # C108V14227M). Employees were standing on the elevated wooden pallet without any fall protection and placing labels on shelving units in the warehouse. Among other methods, one feasible and acceptable method of abatement is to follow the American National Standard Institute ANSI/ITSDF B56.1-2005: Safety Standard for Low Lift and High Lift Trucks as applicable - 4.17.2 Whenever a truck is used to elevate personnel, the following precautions for the protection of personnel shall be taken: (c) Be certain that required restraining means such as railings, chains, cable, body belt(s) with lanyard(s), or deceleration devices, etc., are in place and properly used. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation ( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
