Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to caught between and falling hazards:
(a) Location - Warehouse:
On or about 9/14/09, the employer failed to ensure proper lifting of
personnel using a
powered industrial truck and personnel lifting device.
Among other methods, one feasible and acceptable means to correct this
hazard is to
follow the protocols established in ASME B56.1, which includes but is not
limited to:
lifting and lowering personnel smoothly, with caution and only at their
request.
