or were likely to cause death or serious physical harm to its

to the lives, safety or health of its employees. In applying this
paragraph fundamental distinctions between private and public
employment have been recognized.
NOTE: The employees were exposed to the hazards of serious injury
or death from falls when using modified stairs. Feasible means of
of abatement could include installing a stairway designed for
access through a hatchway, as per OGS specifications.
a) NYSDOCCS Great Meadow Corr.Fac.- The upper Alternating Tread
Stairway in the temporary tower was modified by cutting off the
handrails at the top and attaching the stairway to a hatchway. The
handrails are specified by OGS project number M2848-C, drawing
number 5-PH103.

or death from falls when using Alternating Tread Stairs that were
not installed according to the OGS specifications. Feasible
abatement methods could include installing stairs at the proper
angle, as specitied in OGS drawing number 1 PH-102 sheet 2 ground
level plan.
a) NYSDOCCS Great Meadow Corr. Fac. - The upper Alternating Tread
Stairs in the temporary tower was not installed in accordance with
OGS project number M2848-c. The stairway was installed at a 75
degree angle.
b) NYSDOCCS Great Meadow Corr. Fac. - The lower Alternating Tread
Stairs in the temporary tower were not installed in accordance with
OGS specifications. The stairway was installed at a 60 degree
angle.
