Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a fall hazard because the ladder was not
extended above the roof
eave. Employees were using an improperly extended ladder in excess of 11
feet from the ground
to gain access to an open sided platform for window sealant maintenance on
a commercial
building window.
An acceptable abatement method for correction of this hazard would be to
extend the
ladder 21-23 inches above the step off point in accordance with Table 27
of Section
9.2.1.3.1 Extension Ladders of the American National Standards Institute
