Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a tipping hazard when not wearing restraints:
a)Warehouse Area:Employer failed to require employee to wear restraint
devices such
as seat belts when operating powered industrial trucks.
Violation observed on or about 1/26/10
AMONG OTHER MEANS, ONE FEASIBLE METHOD TO CORRECT THE HAZARD
WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE
SEATBELTS AND REINFORCE THIS REQUIREMENT TO THE EMPLOYEES
DURING TRAINING.
