Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a stuck-by hazard by operating a SPANCO 2-ton overhead underhung crane at the Fill Out Station with the emergency stop button missing from the pendant. Among other methods, one feasible and acceptable method to correct this hazard is to have the employer repair the pendant in accordance with ASME B30.11-1998 Section 11- 2.3.3(d)(3). Among other methods, one feasible and acceptable method to correct this hazard is to have the employee wear clean disposable gloves when handling the pendant to prevent paint from contaminating the pendant. The pendant should be repaired in accordance with ASME B30.11-1998 Section 11-2.3.3(d)(5) to identify all functions. Among other feasible methods, one feasible method to correct this hazard would be to inspect the crane/hoist assembly and have the report maintained in accordance with ASME B30.11-1998 Section 11-2.2.1.
