North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish employment and a place of
employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to fire and explosion hazards
due to the lack of
equipment to control and/or isolate a dust deflagration:
a)production area, enclosed screw conveyors used to transport
shredded/ground
polyurethane to material storage hoppers did not have equipment to vent and
isolate a dust deflagration.
b)production area, pneumatic ducting system used to transport processed
polyurethane materials through cyclones and from storage hoppers to the
weighing
hopper and then to the blend tank did not have equipment to isolate a dust
deflagration.
c)production area, seven cyclone dust separators throughout the production
area
were located inside the building without equipment to vent and isolate a
dust
deflagration and also exhausted the air inside the building.
Feasible and acceptable methods to correct these hazards is to install
explosion protection in
accordance with National Fire Protection Association (NFPA) 654, Standard
for the Prevention
of fire and dust Explosions from the Manufacturing, Processing, and
Handling of Combustible
Dust Particulate Solids (2006), paragraphs 7.11.1.1,7.1.4.1, 7.13.1.1.1,
and 7.13.1.7.1.

to employees in that employees were exposed to fire and explosion hazards
due to the lack of
dust control:
a)production area, the screen tent enclosures installed on storage
hoppers, weighing
hoppers and blend tanks were not dusttight or equipped with continuous
suction
to control the escape of fugitive dust during normal operation.
b)production area, near the roll-up door entering the packaging/laminating
area,
pneumatic transport ducting was not maintained in such a manner to
minimize the
escape of fugitive dust during normal operation.  On 12/14/09, 12/16/09,
12/18/09, and 3/12/10, a number of leaks were observed at different points
along
the transport duct line contributing to a build-up of combustible dust in
the area.
Feasible and acceptable methods to correct these hazards is to install
dust controls in accordance
with National Fire Protection Association (NFPA) 654, Standard for the
Prevention of fire and
dust Explosions from the Manufacturing, Processing, and Handling of
Combustible Dust
Particulate Solids (2006), paragraphs 8.1.1, 7.17.1, 7.2.3.2.2, and
8.2.1.1.

due to not controlling
static electricity ignition sources:
a)production area, enclosed screw conveyors used to transport
shredded/ground
polyurethane to material storage hoppers were not bonded and grounded to
control ignition hazards from static sparks.
b)production area, pneumatic ducting system used to transport processed
polyurethane materials from storage hoppers to the weighing hopper and
then to
the blend tank were not bonded and grounded to control ignition hazards
from
static sparks.
c)production area, seven cyclone dust separators throughout the production
area
were not bonded and grounded to control ignition hazards from static
sparks.
One feasible and acceptable method to correct this hazard is to install
explosion
protection in accordance with National Fire Protection Association (NFPA)
654, Standard
for the Prevention of Fire and Dust Explosions from the Manufacturing,
Processing, and
Handling of Combustible Dust Particulate Solids (2006), section 9.3.1.3
states "Bonding
and grounding with a resistance of less than 1.0 x 106 ohms to ground
shall be provided
for conductive components."
