Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
lifting and moving granite and marble slabs weighing up to 1000 pounds by
means of pressure-
gripping lifting clamps were exposed to crushing injuries from falling or
slipping slabs while
positioned within the "fall shadow" of the load being moved:
On or about December 30, 2009, an employee who had been performing
operations related to
releasing the clamp while standing in the "fall shadow" of a granite slab
on the flatbed of a 2005
International 4300 truck was fatally injured by the impact of his head on
the concrete floor of
the warehouse and the impact of at least one chunk of the broken slab to
his face.
Among other methods, feasible and acceptable methods of abating this
condition would include
the following:
1.Development and implementation of a policy prohibiting employees being
positioned
within the path or "fall shadow" during the handling of slabs where
falling slabs can
present crushing injuries, as is recommended practice throughout the stone
and marble
industry;
2.Development and implementation of safe slab handling procedures,
instruction of
employees on those procedures, and enforcement of those procedures, as
recommended
by SHIB 08-12-2008, "Hazards of Transporting, Unloading, Storing and
Handling
Granite, Marble and Stone Slabs" and MIA Technical Module, "Safety in the
Stone
Business";
3.Consideration of the use of slings or wire rope cables rather than
clamps.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of being hit or crushed from falling granite
or marble slabs:
1.The red clamp had no labels giving information including but not limited
to the rated
load capacity, the manufacturer's name and address, the model number and
serial number
of the device, and safety warning data.
2.There was no documentation of frequent and periodic inspection of the
red clamp
(manufacturer unknown) and the Abaco 50 heavy duty lifter clamps.
3.Training on the clamps and on safe slab handling practices was not
adequate to prevent
incidents involving the dropping of slabs.
Among other methods, feasible and acceptable methods of abating the
conditions noted above
include:
1.Labeling the red clamp with information, in accordance with ASME
B30.20-2006,
Section 20-1.2.1.
2.Conducting frequent and periodic inspections of the clamps, in
accordance with ASME
B30.20-2006, Sections 20-1.3.3 and 20-1.3.4, and repairing or replacing
damaged or
worn parts accordingly.
3.Testing the clamps prior to use by a qualified person, in accordance
with ASME B30.20-
2006, Section 20-1.3.8.
4.Providing thorough and comprehensive training of employees involved in
any aspect of
slab handling, in accordance with the manufacturer's operation manuals and
with ASME
B30.20-2006, Section 20-1.4.2, including but not limited to safe
application of the clamp
to slabs of different sizes and thicknesses; safe work practices for
operations that are
potentially the most hazardous; inspection, cleaning, and storage
procedures; and
certification of the ability to handle lifting equipment safely by
employees who will
perform those operations.
