P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of contracting Methicilin-resistant Staphylococcus Aureus (MRSA) infections: a)Within the facility, on or about April 22, 2010 and at times prior to, employees who worked directly with clients that had MRSA infections were exposed to the hazard of contracting work-related MRSA infections. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED. Among other methods, feasible and acceptable means of abatement are: 1. Formulate an infection control program that is designed specifically for the population at the facility. 2. Expand the surveillance program to include not only clients but also employees with surveillance methods to better assess clusters of new MRSA cases among residents and employees. 3.Educate and encourage employees to report any skin lesions or concerns related to MRSA infections without fear of adverse action. 4.Review cleaning and disinfecting procedures with housekeeping and direct care staff (e.g., the agents including germicidal detergents, sites where agents are to be used, and the frequency of use). 5.Replace cloth chairs with more easily cleanable material. 6.Formulate and implement a clear, consistent method of communication to staff concerning MRSA-infected clients and patient placement. 7.Evaluate the infection control program annually and surveillance data monthly or more frequently as needed. 8.Communicate evaluation findings to both management and employees.
