P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that in that
employees were exposed to crushing, caught-in, struck-by and amputation
hazards:
a)Jobsite, on or about and at times prior to May 19, 2011, employees
entered the
machine hopper to clean the paddle auger of a high production concrete
curb and
gutter machine, Kurber 5000, with the engine idling were exposed to
crushing,
caught-in, struck-by, and amputation hazards.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to:
1.Follow the manufactures operation and maintenance manual page 29, which
pertained to engine stopping after working under load:  Remove the load
from the
engine. Reduce the engine speed (rpm) to low idle. Perform this procedure
for
five to six minutes in order to cool the engine, then clean the hopper and
paddles
with engine in the off mode.
2.Establish written procedures that address engineering controls and
lockout
procedures for employees who are required to clean hopper and paddles with
engine idling.
3.Seek guidance from the manufacturer when its operator manual is silent
about
cleaning hopper and paddles with engine idling.
