Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to struck-by and caught-between hazards: This violation most recently occurred on June 18, 2011, at a workplace located at State Highway 121 and Dallas North Tollway, Plano, Texas 75024, when the employer had employees hold onto a suspended mechanically stabilized earth (MSE) concrete panel to restrict the panel's movement as it was being transported by a JLG / Gradall, model G6-42A telehandler, and exposed the employees to struck-by and caught-between hazards. Among other methods, a feasible and acceptable method to correct this hazard is to comply with the JLG / Gradall Owner/Operator Manual for the model G6-42A telehandler which requires tag lines to be used to guide and steady suspended loads that are long enough to keep helpers clear of the load and handler; and, beware of wind which can cause a suspended load to swing and create dangerous side loads. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit an abatement plan describing the actions it is taking compliance with this requirement, including describing the steps that it is taking to ensure that they are following the telehandler manufacturer's requirements for transporting a suspended load.nded
