Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards and struck-by hazards during the operation of powered industrial trucks which did not have restraint systems (seatbelts) installed. a) Throughout the facility - on or about 10/28/10 employees operated the Nissan type L forklift (LPG powered) and the Hyster forklift (LPG-powered after conversion) for loading and unloading materials in the Shop and in the Warehouse. Neither of the two vehicles had seatbelts installed. Abatement method: Among other methods, one feasible and acceptable abatement method to correct this hazard is to install and utilize a restraint system in accordance with the current version of the American National Standards Institute (ANSI)/Industrial Truck Standards Development Foundation (ITSDF) B56.1-2009, "Safety Standard for Low Lift and High Lift Trucks". In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling object hazards and struck-by hazards created by the use of lifting equipment (below-the-hook devices) in an unsafe condition. a) Shop, Spiral Area - On or about 10/28/10, employees operated the two 1 Ton cranes in order to lift the 1000-1300 lb. sheet metal coils for the Spiral-Helix spiral duct machines, models 100 and 200. The coils were suspended by a chain sling and a below-the-hook device (in-house built). The device was placed in service but not designed by a qualified person, and was not tested, inspected, labeled and certified. Abatement method: Among other methods, a feasible and acceptable abatement method to correct these hazards is the fulfillment of the requirements of the American Society of Mechanical Engineers, ASME B30.20-2006, "Below the Hook Lifting Devices", which includes 1) Design of the below-the-hook device by a qualified person. 2) Load-testing of the device with certification. 3) Labeling of the device to visibly indicate the rated capacity. 4) Implementation of frequent and periodic inspections. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards created by the operation of power press brakes with unprotected treadle/pedals. a) Shop, Press Area - On or about 10/28/10, employees operated the Chicago hydraulic press brake S.N. 625010, and no protective device was installed to prevent the accidental activation of the treadle/pedal due to falling/moving objects or human/coordination error. b) Shop, Press Area - On or about 10/28/10, two employees operated the Roto-Die press brake at the same time, and no protective device was installed to prevent the accidental activation of the treadle/pedal due to falling/moving objects or human/coordination error. Abatement method: Among other methods, a feasible and acceptable abatement method to correct this hazard is to provide a safety device for the treadle/pedal that meets the requirements of ANSI B11.3-2002 section 6.10.4 Safety Requirement for Power Press Brakes, which states: When provided, foot controls shall be protected to prevent actuation from falling or moving objects, or from unintended activation. 1) You are not limited to the abatement metods suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
