Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a struck by hazard:
On or about May 11, 2010, at 3200 England Parkway, Grand Prairie, Texas,
employees
performing lawn care operations were exposed to the hazard of being struck
by vehicular traffic
while working near a curb outside of a temporary traffic control zone.
The lane was not closed
with the appropriate warning devices. A feasible means of abatement would
be to conform with
Part VI Temporary Traffic Control of the Manual of Uniform Traffic Control
Devices, 2009
Edition which addresses providing adequate warning, delineation, and
channelization to assist
in guiding road users in advance of and through the temporary traffic
control zone or incident
site by using proper pavement marking, signing, or other devices that are
effective
under varying
conditions.
