Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Reference: Standard for Automotive Lifts- Safety Requirements for Operation, Inspection and Maintenance (ANSI/ALI ALOIM-2008) Chapter 4.4 Operator Responsibilities 4.4.4: The lift owner or employer shall take all appropriate steps to follow the recommended inspection procedures of the lift manufacturer, but in no even shall the lift operator fail to inspect or take notice of the following features on a daily basis: (1) Accessibility and readability of operating procedures, safety tips and generic safety material; (2) Accessibility and readability of safety warning labels; (3) Readability of the rated load capacity of the lift; (4) Proper operation of the lift controls, (including over-travel shut off devices and synchronizing systems), restraints and locking devices; (5) Deformation or excessive wear of any of the lift structural components: (6) Deformation or excessive wear of other components such as hoses, electrical wires, drive chains, wire rope or screws; (7) Damage or excessive wear on any of lift contact points which engage the vehicle during lifting, whether they engage the tires, frame, body or axles; (8) Evidence of hydraulic or pneumatic leaks; (9) Unusual noises, sudden movements, erratic operation or evidence of chips or filings during use; and (10) Cracks or loose concrete around floor anchor bolts, if employed. 4.5 Operator Reporting. If any of the conditions described above are observed before, during or after operation of the lift, the operator shall stop using the lift and report the condition to the supervisor, the employer or owner. If any of the conditions listed in the 4.4.4 (4) though (10) are observed, then the lift shall not be used until the cause of the problem has been determined and the appropriated repairs have been made by qualified automotive lift service personnel. In order to ensure that the lift is not used until de repairs have been effected, the lift shall be locked out or tagged out in accordance with ANSI Z2244.1. At the Carlos A Reyes Colon dba PR Muffler Shop, it was observed that the automotive lift (trademark Bend Pak, Inc, model mx-10acx, serial #54071, capacity 10,000 pounds, 220 volts, and 18amp) had the safety cable pin broken. It was documented that the employees used the automotive lift in mechanics task as but not limited to: muffler repair, break repairs, oil change, belts change, repair and tire change to cars. Hazard: Employees being struck, as a result of inadvertent descent from the automotive lift. Among other methods, one feasible and acceptable method to correct this hazard is: install a brand new safety cable pin to the automotive lift. Referencia: Norma para Elevadores de Automoviles - Requerimiento de Seguridad para la Operacion, Inspeccion y Mantenimiento (ANSI/ALI ALOIM-2008) Capitulo 4.4 Responsabilidades del Operador 4.4.4 El dueno de un elevador (pino) o el patrono debera adoptar todas las medidas apropiadas para seguir los procedimientos de inspeccion recomendados por el fabricante de los elevadores, pero en ningun instante debera el operador fallar en inspeccionar o tomar nota de las siguientes caracteristicas a diario: (1) Accesibilidad y legibilidad de los procedimientos de operacion, consejos de seguridad y los materiales genericos seguridad; (2) Accesibilidad y legibilidad de las etiquetas de advertencia de seguridad; (3) La legibilidad de la capacidad de carga nominal del elevador; (4) Adecuado funcionamiento de los controles de elevacion, (incluyendo los dispositivos de sobre-recorrido de cierre y los sistemas de sincronizacion), las restricciones y los dispositivos de bloqueo; (5) Deformacion o desgaste excesivo de cualquiera de los componentes estructurales de elevacion; (6) Deformacion o desgaste excesivo de otros componentes, tales como mangueras, cables electricos, cadenas de transmision, cable de alambre o tornillos; (7) Los danos o un desgaste excesivo en cualquiera de los puntos de contacto que compromete el vehiculo durante el levantamiento, si se involucran los neumaticos, el marco, el cuerpo o ejes; (8) Evidencia de liqueos hidraulicos o neumaticos; (9) Ruidos inusuales, movimientos bruscos, el funcionamiento irregular o evidencia de astillas o limaduras durante el uso, y (10) Las grietas o suelo suelto del hormigon o alrededor de los pernos de anclaje, si se utilizan. 4.5 Reportes del Operador Si alguna de las condiciones descritas anteriormente se observan antes, durante o despues de la operacion del elevador (pino), el operador debera dejar de usar el elevador (pino) e informar de la situacion al supervisor, al patrono o el propietario. Si alguna de las condiciones enumeradas en la 4.4.4 (4) hasta (10) se observan, el elevador (pino) no se utilizara hasta que la causa del problema se halla determinado y las reparaciones apropiadas hallan sido realizadas por personal calificado de elevadores automoviles (pinos). Con el fin de asegurar que los elevadores (pinos)no sean utilizados hasta que las reparaciones se efectuen, el elevador debera ser bloqueado o etiquetado de conformidad con la norma ANSI Z2244.1. En Carlos A Reyes Colon dba PR Muffler Shop, se observo que el pino de levantar autos (marca Bend Pak, Inc, modelo mx-10acx, serie #54071, capacidad de 10,000 libras, 220 voltios y 18 amperios) tenia el cable de seguridad del pasador ("pin") roto. Se documento que los empleados usaban el pino de levantar autos en tareas de mecanica tales como y no limitadas a: reparacion de silenciadores, reparacion de frenos, cambios de aceites, cambio de correas, reparacion y cambio de gomas. Riesgo: Empleados pueden ser golpeados, como resultado de descenso inadvertido del pino de levantar autos. Entre otros metodos, un metodo factible para corregir esta situacion es: instalar un nuevo cable con pasador ("pin") de seguridad al pino de levantar autos.

Hazard: Employees exposed to domestic violence in the workplace. One method among others to abate this hazard: develop a written protocol to handle domestic violence in the workplace and provide training to all the employees, for have knowledge and act if this situation is presented. The Women's Advocate Office will provide to the employer the necessary technical guidance for implementation of the protocol. Empleados de Carlos A Reyes Colon dba PR Muffler Shop, mientras trabajaban en tareas de mecanica, estaban expuestos a lesiones y enfermadades debido a que el patrono no tenia un protocolo escrito de violencia domestica en el lugar de trabajo, requerido bajo la Ley para la Implementacion del Protocolo de Situaciones de Violencia Domestica en el Lugar de Trabajo o Sitio de Empleo, Ley numero 217 del 29 de septiembre de 2006, y la Ley numero 16 del 5 de agosto de 1975 segun enmendada. Riesgo: Empleados expuestos a Violencia Domestica en el lugar de Trabajo. Un metodo para disminuir el riesgo: Desarrollar un protocolo escrito de violencia domestica en el lugar de trabajo y proveer adiestramiento a todos los empleados, para que tengan conocimiento y actuen en caso de que se presente esta situacion. La Oficina de la Procuradora de la Mujer provee al patrono las guias necesarias para la implementacion del protocolo.
