Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a fall: a) On or about 01/25/2011, an employee was using an 8' self supporting portable ladder. The top or top step of a stepladder was used as a step. The employee was using the ladder to trouble shoot a light of a gas station bay. While using the ladder the employee was exposed to a fall of approximately 7' to the concrete ground below. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ANSI-ASC A14.5-2007. Section 9 of this standard addresses this hazard, specifically 9.3.2 Climbing and Working Locations.ly

The employee was using the rear brace as a step/ rung. The rear brace was not designed for this use. The employee was using the ladder to trouble shoot a light of a gas station bay. While using the ladder the employee was exposed to a fall of approximately 7' to the concrete ground below. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ANSI-ASC A14.5-2007. Section 9 of this standard addresses this hazard, specifically paragraphs 9.3.2 Climbing and Working Locations and 9.3.16 Bracing of Stepladders.
